Simple Arson

There are several different offences that fall under arson, which include simple arson, arson (being reckless as to whether life is endangered) and arson with intent to endanger life.

The offence of ‘simple arson’ occurs when a person causes criminal damage by fire. Some examples of this include setting fire to a car, shed or a commercial property. This is a serious offence and if serious damage is caused, the case will be heard in the Crown Court where a person could be given a sentence of life imprisonment. If minor damage has occurred, it is possible for the case to be kept in the Magistrates’ Court where it is possible to avoid a prison sentence and receive a community order.

If charged, the factual circumstances surrounding the offence will differ on a case by case basis and this will determine whether there is scope to challenge the prosecution and whether the case is sent to the Crown Court.
