What is Being Concerned in the Supply of Drugs?

Under the Misuse of Drugs Act 1971, the offence of “being concerned in the supply of drugs” involves participating in the supply chain of controlled substances. This could include making arrangements, facilitating communication, or otherwise assisting in the supply of drugs, even if you are not the individual physically handing over the drugs.

To prove this offence, the prosecution must demonstrate that:

  • You had knowledge of the supply of controlled drugs;
  • You were involved in the process in some way, whether through arrangement, facilitation, or enabling supply.

This offence applies to all classes of drugs:

Being Concerned in the Supply of Class A Drugs

Class A drugs include substances such as heroin, cocaine, ecstasy, and methamphetamine. Convictions for involvement in the supply of Class A drugs carry the harshest penalties, with custodial sentences that can extend to life imprisonment in the most serious cases.

Being Concerned in the Supply of Class B Drugs

Class B drugs include cannabis, amphetamines, and synthetic cannabinoids. Offences involving Class B drugs still attract significant custodial sentences, fines, and other long-term consequences.

Being Concerned in the Supply of Class C Drugs

Class C drugs include substances such as anabolic steroids, certain tranquillisers, and prescription medications when misused. While penalties may be lower than those for Class A or B drugs, serious consequences including imprisonment remain possible.

Sentencing for Being Concerned in the Supply of Drugs

Sentencing for this offence is determined by the Sentencing Council guidelines and depends on several factors:

  • The class and quantity of drugs involved;
  • The defendant’s role (leading, significant, or lesser);
  • The scale and sophistication of the operation;
  • Previous convictions.

The maximum sentences are:

  • Class A Drugs: Life imprisonment and/or an unlimited fine;
  • Class B Drugs: 14 years’ imprisonment and/or an unlimited fine;
  • Class C Drugs: 14 years’ imprisonment and/or an unlimited fine.

Legal Defences for Being Concerned in the Supply of Drugs

A range of legal defences may be available depending on the specifics of your case. At Kang & Co Solicitors, we meticulously examine all aspects of the evidence and case circumstances to identify the strongest possible defence. Potential legal defences include:

Lack of Knowledge:

To secure a conviction, the prosecution must prove that you knew about the supply of drugs. If it can be shown that you had no knowledge of the drugs or any illegal activity, this can serve as a strong defence.

Minimal or Incidental Involvement:

Even if there is some connection to individuals involved in drug supply, you may not have been actively participating or aware of the illegal conduct. Demonstrating a minimal, innocent, or peripheral role can lead to a reduction in charges or acquittal.

Duress:

If you were coerced or threatened into participating in the offence, for example through intimidation or fear of violence, you may have a valid defence of duress. This involves proving that you were compelled to act under the threat of serious harm.

Mistaken Identity:

In cases involving multiple individuals, particularly those reliant on surveillance or witness identification, it is possible to challenge the prosecution on the grounds that you have been wrongly identified.

Lack of Intent:

The offence requires knowing participation. If you were unknowingly involved, or your actions were misinterpreted, this may undermine the prosecution’s case.

Procedural Irregularities or Abuse of Process:

If the police or prosecution have failed to follow correct procedures or violated your legal rights, this may provide grounds to challenge the admissibility of evidence or even have the case dismissed.

Entrapment / Abuse of Process:

If law enforcement induced you to commit an offence that you would not have otherwise committed, an argument of Abuse of Process may be raised in your defence.

Each case is unique, and early legal advice is crucial to building a strong and effective defence. Our specialist solicitors will carefully analyse the evidence, interview witnesses, and explore all avenues to protect your interests and achieve the best possible outcome.
