What is the Offence of Being Drunk on an Aircraft?

Under Section 73 of the Civil Aviation Act 1982, it is a criminal offence to be drunk on an aircraft. The legislation aims to ensure passenger safety, prevent disorderly or dangerous conduct on board, and allow cabin crew and flight staff to carry out their duties without interference.

The offence applies to both domestic and international flights departing from or arriving in the UK and can be committed by any passenger who is found to be intoxicated through alcohol or drugs.

The offence is typically committed when:

  • A passenger is found to be intoxicated while boarding or on board an aircraft;
  • Their level of drunkenness poses a risk to the safety of the aircraft, crew, or passengers;
  • Their behaviour is disruptive or aggressive, or prevents the flight crew from safely operating the aircraft.

This offence is often associated with other criminal charges such as:

  • Drunk and disorderly conduct;
  • Endangering the safety of an aircraft (Section 80 of the Civil Aviation Act 1982);
  • Common assault (if other passengers or crew are affected);
  • Failure to comply with safety instructions from cabin crew.

The maximum penalty for being drunk on an aircraft is:

  • Up to 2 years’ imprisonment and/or
  • An unlimited fine

In practice, sentencing will depend on:

  • The level of intoxication;
  • Whether the individual was disruptive or aggressive;
  • Whether the flight was delayed or diverted as a result;
  • Prior criminal convictions;
  • Evidence of remorse or cooperation with authorities.

Legal Defences for Being Drunk on Aircraft

At Kang & Co Solicitors, we understand the significant consequences that an allegation of being drunk on an aircraft can have on your career, reputation, and future travel opportunities. Our legal team will thoroughly examine the facts of your case and identify the most appropriate defence strategy. Common defences include:

  1. Disputing Intoxication

One of the most common defences is disputing that the defendant was “drunk” in the legal sense. While the law does not specify a blood-alcohol level like with drink driving, the prosecution must still prove beyond reasonable doubt that you were intoxicated to a level that posed a safety risk.

We may challenge:

  • The accuracy of observations made by cabin crew or police;
  • The lack of objective evidence (e.g., no breathalyser or medical assessment);
  • Witness reliability or inconsistencies in statements.
  1. Lack of Disruptive Behaviour

Mere consumption of alcohol is not illegal—many passengers consume alcohol during a flight. It must be shown that the level of drunkenness impacted safety or conduct. If you were not disorderly or aggressive, and there was no interference with the flight, a defence may be raised that the conduct did not breach the legal threshold.

  1. Unintentional Intoxication

In rare cases, individuals may unknowingly become intoxicated due to drink spiking, medication interaction, or medical conditions affecting alcohol metabolism. If it can be shown that intoxication was not voluntary or foreseeable, a defence may be possible.

  1. Procedural Irregularities

As with all criminal prosecutions, proper police procedure must be followed. Our solicitors will examine:

  • Whether you were lawfully detained and cautioned;
  • The accuracy and lawfulness of any statements or interviews;
  • Whether evidence was lawfully obtained and admissible.
  1. Human Rights or Proportionality Arguments

In some cases, especially if there was minimal disruption and a disproportionate police response, arguments may be raised about the public interest in prosecuting or whether prosecution breaches your rights under the Human Rights Act 1998.

Each case is unique, and early legal advice is essential to preserve your position and explore all available avenues of defence.
