What is Possession of Drugs?

Possession of drugs is an offence under the Misuse of Drugs Act 1971, which makes it illegal to possess controlled substances without lawful authority. The seriousness of the offence depends on the class of drug involved and the circumstances of the case.

To secure a conviction, the prosecution must prove:

  • You were in possession of a controlled drug.
  • You knew you had the drug in your possession.

There are three main categories of controlled drugs in England and Wales:

AGREED FEE
CRIMINAL LAWYERS

 Our Agreed Fees for Private Crime cases start from;

£3,000 + VAT

Possession of Class A Drugs

Class A drugs include substances such as heroin, cocaine, ecstasy (MDMA), methamphetamine, and LSD. Possession of Class A drugs is treated most seriously by the courts and carries the harshest penalties.

Possession of Class B Drugs

Class B drugs include cannabis, amphetamines, codeine, and synthetic cannabinoids. While possession of Class B drugs is considered less serious than Class A, it still carries significant legal consequences.

Possession of Class C Drugs

Class C drugs include substances such as anabolic steroids, benzodiazepines, and certain prescription medications when possessed unlawfully. Although treated less severely than Class A or B, convictions for Class C drug possession can still result in serious penalties.

Sentencing for the Possession of Drugs

Sentencing for drug possession offences depends on several factors, including the type and quantity of the drug, previous convictions, and the offender’s personal circumstances.

Possession of Class A Drugs:

  • Maximum sentence: 7 years’ imprisonment and/or an unlimited fine.

Possession of Class B Drugs:

  • Maximum sentence: 5 years’ imprisonment and/or an unlimited fine.

Possession of Class C Drugs:

  • Maximum sentence: 2 years’ imprisonment and/or an unlimited fine.

In many cases, the courts may consider alternatives to custody, such as fines, community orders, drug rehabilitation requirements, or conditional discharges, particularly for first-time offenders or those caught with small quantities.

Find out more about sentencing for the Possession of Drugs by visiting the Sentencing Councils guidelines page.

Legal Defences for the Possession of Drugs

Each drug possession case is unique, and there are various potential legal defences that may apply. At Kang & Co Solicitors, we will carefully assess the evidence and circumstances to build the strongest possible defence. Some of the common legal defences include:

Lack of Knowledge

To secure a conviction, the prosecution must prove that you knew the substance was in your possession. If you were unaware of the presence of the drug, this could form the basis of a defence.

The Substance Was Not a Controlled Drug

If the substance seized by police was not a controlled drug under the Misuse of Drugs Act 1971, there is no case to answer.

Unlawful Search or Breach of Procedure

If the police acted unlawfully when searching you, your vehicle, or your property, or if they breached procedural safeguards, it may be possible to challenge the admissibility of the evidence obtained.

Temporary or Innocent Possession

You may have held the substance temporarily for the purpose of discarding it or under duress, without any intention to use or control it.

Duress or Coercion

In some cases, individuals are coerced into holding drugs by threats of harm. If it can be shown that you acted under duress, this may form a viable defence.

Mistaken Identity

If the prosecution’s case relies on mistaken identity or weak evidence connecting you to the drugs, we will challenge the reliability and credibility of the evidence.
