What is Racially-Aggravated Assault?
Under British law, racially-aggravated assault is defined as a physical attack or violent behaviour motivated by hostility or prejudice towards an individual’s race, ethnicity, or nationality. The offence is governed by Section 28 of the Crime and Disorder Act 1998, which enhances penalties for assault offences that are aggravated by racial or religious prejudice.
The law recognises several types of racially-aggravated assault, including:
- Common Assault (S. 39 of the Criminal Justice Act 1988)
- Assault Occasioning Actual Bodily Harm (ABH) (S. 47 of the Offences Against the Person Act 1861)
- Grievous Bodily Harm (GBH) (S. 20 of the Offences Against the Person Act 1861)
For an assault to be classified as racially aggravated, the prosecution must demonstrate that either before, during, or after the offence, the accused exhibited hostility based on the victim’s race, ethnicity, or nationality. This can include verbal abuse, gestures, or any behaviour that indicates racial prejudice.

Sentencing for Racially-Aggravated Assault
Racially-aggravated assault carries more severe sentencing compared to non-aggravated assault due to the additional element of racial or religious hostility. According to the Sentencing Council’s Guidelines, sentences vary depending on the type and severity of the assault and the presence of aggravating factors, such as prior criminal history or the extent of injury caused.
- Racially-Aggravated Common Assault: Can result in a custodial sentence of up to 2 years.
- Racially-Aggravated ABH: Carries a potential sentence of up to 7 years in prison.
- Racially-Aggravated GBH: May lead to a custodial sentence of up to life imprisonment in the most serious cases.
The court will also consider mitigating factors, such as a lack of prior convictions, expressions of remorse, or evidence of rehabilitation, when determining the sentence. However, due to the racial aggravation, the starting point for sentencing is often higher than for non-aggravated assault offences.

Legal Defences for Racially-Aggravated Assault
When facing allegations of racially-aggravated assault, there are several legal defences that may be applicable. At Kang & Co Solicitors, our experienced defence team will closely examine the evidence against you, identify any weaknesses in the prosecution’s case, and build a robust defence strategy. Key defences that may apply include:
Lack of Racial Motivation
One of the primary elements in a racially-aggravated assault charge is the motivation or intent behind the act. If it can be demonstrated that the assault was not motivated by racial hostility, this may serve as a defence. Our team will carefully analyse witness statements, video evidence, and other relevant materials to challenge the presence of racial motivation.
Self-Defence
If the assault occurred as a response to an immediate threat of harm or danger, a self-defence argument may apply. This requires demonstrating that your actions were necessary and proportionate to the perceived threat. Self-defence can serve as a valid defence to both the assault and any associated aggravating factors.
Mistaken Identity or False Accusation
In cases where there is little concrete evidence or eyewitness misidentification, there may be grounds to argue mistaken identity. Our solicitors will work to uncover any discrepancies in the prosecution’s case and ensure that only reliable, objective evidence is considered.
Procedural Errors and Rights Violations
Law enforcement is required to adhere to strict procedures when handling evidence and interviewing suspects. Any procedural errors or breaches of your rights may be grounds for challenging the case against you. Our legal team will scrutinise all aspects of the investigation process, from arrest to trial, to ensure that your rights were upheld throughout.
Pre-Charge Advice & Representation
