What is Racially or Religiously Aggravated Threatening Behaviour?
Racially or religiously aggravated threatening behaviour is a serious offence that builds upon the standard offence of threatening behaviour under Section 4 of the Public Order Act 1986. This offence occurs when an individual uses threatening, abusive, or insulting words or behaviour, or displays any written or visible representation that is threatening, abusive, or insulting, with the intent to cause another person to fear immediate unlawful violence or to provoke such violence.
What sets this offence apart is the aggravating factor of racial or religious hostility. The aggravation can be proven if the offence was motivated by hostility towards the alleged victim’s race or religion, or if the behaviour was accompanied by derogatory remarks related to the victim’s race, colour, nationality, ethnic or national origin, or religion. This added element makes the offence significantly more serious in the eyes of the law, leading to significantly harsher penalties and a greater focus on public safety.

Sentencing Guidelines for a Racially or Religiously Aggravated Threatening Offence
Sentencing for racially or religiously aggravated threatening behaviour is influenced by both the Public Order Act 1986 and the Crime and Disorder Act 1998. The offence can be tried in either the Magistrates’ Court or the Crown Court, depending on the severity of the incident.
In the Magistrates’ Court, the maximum sentence for this offence is six months imprisonment and/or an unlimited fine. However, if the case is tried in the Crown Court, the maximum penalty increases to two years imprisonment and/or an unlimited fine.
The Sentencing Council’s guidelines place significant weight on the racial or religious aggravation, which often leads to an uplift in the sentence. Factors such as the severity of the threats, the impact on the victim, whether the offence was premeditated, and any previous criminal history will be considered when determining the sentence. Aggravating factors, such as the use of weapons or targeting a particularly vulnerable individual, can result in even harsher penalties. Conversely, mitigating factors like showing genuine remorse or lack of prior convictions may reduce the severity of the sentence.

Legal Defences for Racially or Religiously Aggravated Threatening Behaviour
When facing a charge of racially or religiously aggravated threatening behaviour, understanding the available legal defences is crucial. At Kang & Co Solicitors, our experienced legal team is skilled in identifying and deploying these defences to protect your rights and achieve the best possible outcome.
Lack of Racial or Religious Motivation
One key defence is challenging the aggravation element by demonstrating that the offence was not motivated by racial or religious hostility. If it can be shown that your actions were not influenced by the victim’s race or religion, this could reduce the charge to a standard Public Order offence, which carries less severe penalties.
Self-Defence
If your actions were a response to an immediate threat to your safety or the safety of others, you may have a valid self-defence argument. It is essential to demonstrate that your behaviour was a necessary and proportionate response to the perceived threat.
Lack of Intent
To secure a conviction, the prosecution must prove that you intended to cause fear or provoke violence. If you lacked such intent, this could serve as a defence. For example, if the threatening behaviour was accidental or misinterpreted, this may negate the charge.
Insufficient Evidence
The prosecution must prove all elements of the offence beyond reasonable doubt. This includes the nature of the behaviour and the racial or religious aggravation. We will rigorously challenge the evidence presented, including witness testimony and any alleged racial or religious hostility, to undermine the prosecution’s case.
Procedural Defences
We will also scrutinise the procedures followed during your arrest and investigation to ensure that your rights were not violated. Any procedural errors or breaches can form a strong basis for your defence.
Each case is unique, and at Kang & Co Solicitors, we will tailor our defence strategy to the specifics of your situation, ensuring that every possible angle is explored.
