Have you Committed a Driving Offence in Derbyshire?

Whether you live or work in Derby / Derbyshire, if you are suspected to have committed a driving offence within Derbyshire, your driving offence prosecution will be issued by Derbyshire Police / Crown Prosecution Service, and your case will usually be listed at Derby Magistrates’ Court, this is because the alleged driving offence is believed to have occurred within the jurisdiction of Derby, therefore the prosecution is listed within the area the alleged offence occurred.

We are frequently instructed by clients living and working in Derby to defend motoring offence prosecutions for offences which are alleged to have occurred throughout the Midlands and Derby.

Specialist Motoring Lawyers

At Kang & Co Solicitors our ethos is straightforward and simple. We provide all our clients with first-class legal advice and representation to ensure that our clients have the best opportunity for a successful outcome.

Our motoring lawyers are open and honest with all our clients from the initial call with regards to all aspects of their case, and all our solicitors and barristers provide clear honest advice following a full assessment of the case.

We are ethical in our approach to ensure we are only involved in your motoring prosecution as far as necessary to make a real difference in the outcome. If we believe that a lawyer is not necessary for your issue, we will advise you from the outset so that you can make an informed decision as to whether you would like to instruct us to act on your behalf.

Kang & Co cover the full range of driving offences from the less serious offences of Speeding, Using a Mobile Phone Whilst Driving, Driving without Insurance, to the more serious offences of Drink Driving and Causing Death by Dangerous Driving.

Avoid a Driving Ban in Derby

If you have been charged with a motoring offence, you should firstly contact one of our specialist solicitors to establish whether you need legal representation for your case. In certain circumstances you may not require representation, if our lawyers form the opinion that you do not require a lawyer for your driving offence, they will inform you from the outset.

If you have a defence, our lawyers will inform you and will recommend that you plead not guilty. We would prepare your case for Trial and provide you with the best chance of being found Not Guilty.

In other circumstances, you may require a solicitor to represent you at Court for your Sentence Hearing to ‘Mitigate’ on your behalf. This is so that you receive the lowest sentence possible. Our lawyers frequently represent clients before Derby Magistrates’ Court. They have many years’ experience in convincing the Court to take into consideration personal mitigation, which can result in avoiding a Driving Ban.

If you already have 6 to 9 penalty points endorsed upon your driving licence and you are facing additional points for a further driving offence, our lawyers can be instructed to make a Special Reasons Argument or an Exceptional Hardship Argument in an attempt to avoid a Driving Ban.

Solicitors Covering the Derby Area

Our closest office is based at 1 Victoria Square in Birmingham. This does not however stop our solicitors frequently representing motorists for motoring offences such as Speeding, Totting-Up, Using a Mobile Phone Whilst Driving and Drink Driving at Derby Magistrates’ Court.

If you do not wish to travel to Birmingham for a face to face meeting, we can offer you full phone conference with your package instead where we will go over you case in fine detail.

If you are seeking to appoint a specialist driving offence law firm for a motoring prosecution before Derby Magistrates’ Court, please get in touch with our lawyers for advice on how we can defend your prosecution or represent you at your Sentence Hearing to mitigate on your behalf, so that you receive the most lenient sentence possible when appearing before Derby Magistrates’ Court.

Travelling from Derby to Kang & Co Solicitors

Travelling to our head office at 1 Victoria Square from Derby is quick and straighforward if you are travelling via train.  Direct trains to Birmingham New Street and Derby Railway Station are every 15 minutes and the journey takes between 35 minutes and 45 minutes. Once you arrive at New Street Station, our office is just a 3-5 minutes walk.

If you are travelling by car to our Birmingham office, the journey is approximately 1 hour if you travel via the A38. The distance between Derby and Birmingham City Centre is around 43 miles. There are plenty of multi storey car parks within close distance of the 1 Victoria Square office.

    Phone & Video Meetings

As we are a specialist law firm, we are frequently appointed to represent clients across the length and breath of England and Wales. Some of our clients are unable to attend our offices because they may live some distance away or they may have limited time and availability to meet with our lawyers in person at our offices, as a result we offer clients the option of a video or telephone meeting with one of our specialist lawyers. If you appoint us to represent you, as part of the case preparation, a meeting will be required and this meeting can take place as a video or telephone conference call. Some of our clients prefer this rather than meeting at our offices, as it eliminates their travelling time and can be done from the convenience of their home or place of work via video conferencing software such as Zoom or GoToMeeting. If you would like more information about having a telephone or video conference, please speak to one of our lawyers and they will be able to answer any questions you may have.

Covering All Driving Offences Including Speeding

Speeding is the most common motoring offence committed throughout England and Wales. The first notification that you will receive is called a ‘Section 172 Notice’ requiring the registered keeper to inform the police of the identity of the person driving when a speed trap was triggered. It is crucial to obtain legal advice early in the process, as a conviction for Failing to Provide Driver Details attracts 6 penalty points.

The penalties that can be imposed for Speeding Offences occurring in Derby can range from penalty points or a driving ban of up to 56 days. If you already have points endorsed upon your driving licence, there is a risk that you could accumulate 12 or more points on your driving licence which will result in a Totting Up Ban of at least 6 months.

If you are unsure of how many active penalty points you have on your driving licence at present, you can check online by using the DVLA Website.
