What is Causing Death by Careless Driving Whilst Under the Influence of Drink?
Under Section 3A of the Road Traffic Act 1988, this offence applies when a driver causes the death of another person by driving carelessly while over the prescribed alcohol limit. The legal alcohol limit in England and Wales is:
- 35 micrograms of alcohol per 100 millilitres of breath
- 80 milligrams of alcohol per 100 millilitres of blood
- 107 milligrams of alcohol per 100 millilitres of urine
Careless driving occurs when the standard of driving falls below what is expected of a competent and careful driver. Combined with being over the legal alcohol limit, this creates an aggravated offence.
Prosecution for this offence requires evidence that:
- The defendant was driving carelessly.
- The defendant was over the alcohol limit at the time of driving.
- The careless driving caused the death of another person.

A robust defence strategy is critical in achieving the best possible outcome. Our solicitors are experienced in identifying and leveraging potential defences, which may include:
Causation
The prosecution must prove that your careless driving was the direct cause of the fatality. If other factors, such as the actions of a third party, contributed to the death, this may weaken the case against you.
Disputing Careless Driving
If your driving did not fall below the standard expected of a competent driver, the charge of careless driving may be challenged.
Breath, Blood, or Urine Test Disputes
Errors in the administration or accuracy of alcohol testing procedures can undermine the evidence against you.
Medical Defences
Conditions such as hypoglycemia or other medical emergencies may explain the driving behaviour.
Every case is unique, and our team will thoroughly examine all aspects of the evidence and the circumstances surrounding the incident to build the most effective defence strategy.
