The Offence of Drug Driving
The offence of drug driving can be found within Section 5A Road Traffic Act 1988. The offence is described as “driving, attempting to drive or being in charge of a motor vehicle with a specified controlled drug in the blood or urine in excess of the specified limit for that drug.”
In order to secure a conviction for drug driving, the prosecution must prove:
- Evidence of driving.
- Evidence of being over the specified limit for that particular drug

What will happen if you are caught Drug Driving?
If you are suspected of drug driving, the police will usually pull you over and conduct a roadside test. To test for drugs, the police will conduct a roadside swab test which is usually from your saliva or sweat and this will test for cannabis and cocaine.
If you pass the roadside swab test (do not fail it) however, the police suspect that there could be another substance other than cocaine or cannabis in your body, they can still arrest you and take you to the police station for further testing.
If you fail the roadside swab test, you will be arrested and taken to the police station for a blood sample which will be used as an evidential specimen.
If you fail to provide a specimen of blood, you may be prosecuted for a separate offence of failing to provide a specimen for analysis which can attract a custodial (prison) sentence along with a driving disqualification of at least 12 months.
Court sentencing powers for Drug Driving
If a defendant is convicted or pleads guilty to drug driving, the Court will impose a mandatory driving disqualification of a minimum of 12 months.
The Court may also impose a fine which can be of an unlimited amount.
Based upon the circumstances of the offence, the Court can impose a Community Order and in most serious circumstances, the Court can impose an immediate custodial (prison) sentence of up to 6 months.
If you plead guilty or are found guilty of drug driving, the charge will show on your criminal record along with your driving licence.
