Our Case Study

Nature of the Offence

Ms Sampson had been pulled over by the police twice in one weekend and had been told by the officers that she did not appear to have valid insurance for that vehicle on the system. Ms Sampson was shocked by this, as she was of the honest belief that she had an insurance policy in place which she knew she had been paying for via direct debit each month. It transpired that the insurance policy had been cancelled by the insurance company due to them not receiving a copy of her ID when she changed vehicle and updated her policy. Ms Sampson was adamant she had not received any correspondence explaining the policy had been cancelled. Our client instructed us to advance a Special Reasons argument in Court.

Where the Offence Occurred

Our client was pulled over twice, once in the Luton area and once in the Milton Keynes area, all within the space of a couple of days. As such, we were able to link both matters into one Court hearing which was heard before High Wycombe Magistrates’ Court.

Special Reasons

Although Ms Sampson was guilty of driving without insurance as her policy had in fact been cancelled, we advanced a Special Reasons argument in Court explaining that Ms Sampson was of reasonable and honest belief that she was in fact insured as she had not received any correspondence notifying her of the cancellation.

Outcome of the Case

Ms Sampson entered a guilty plea for both offences of driving without insurance, highlighting she wishes to put forward a Special Reasons argument. The Court adjourned the case for a Special Reasons Hearing to take place a few months later. At the second Court hearing, our barrister then advanced the Special Reasons argument highlighting that although the policy had been cancelled, there was no evidence that this information had been served upon Ms Sampson therefore, she had no knowledge of this cancellation. In addition to this, she had still been paying her monthly fee for her insurance policy.

The Court granted the Special Reasons argument and our client received just a small fine. Our client therefore avoided the disqualification and avoided receiving any penalty points, which she would have received if she hadn’t had instructed expert lawyers on her case to advance Special Reasons.
